Sending SMS with Url’s is Patented! Protect yourself!

SMS with Url’s is Patented!-Most businesses are completely unaware that sending SMS with Url’s is patented. And not all SMS providers have acquired a license to protect their business from a lawsuit. The company Helferich Patent Licensing LLC owned by Richard Helferich has been on a rampage with lawsuits for more than a year. Many suits have been settled in the amount of $750,000 plus a $0.025 charge for each text message sent both in the past and present. For companies who jumped on the mobile marketing bandwagon early, these charges can be significant.
It is not just technology companies that are the subject of mobile-related patent infringement lawsuits. Increasingly, the mobile marketing activities of media companies, retailers, sports leagues and others are also the focus of such lawsuits. Companies such as New York Times, CBS, Best Buy, the NBA and more have been named in lawsuits. These suits against marketers are significant, especially since they appear to be multiplying.
Some companies under litigation chose to settle vs. undergoing a long and expensive litigation. Helferich’s lawsuit is pretty straightforward; they offer to settle for $750,000 which will give them the appropriate license required. According to the post more than 100 companies have taken the deal. A small list of these companies includes: 7-Eleven, Anheuser Busch, Ace Hardware, Adidas/Reebok, Domino’s Pizza and Best Buy. Those that are choosing to fight are not faring well as the courts are upholding in favor of Helferich.
For these large corporations the cost can be absorbed and they will move on without much impact overall on the business. But for small and medium sized businesses this could completely destroy them.
Don’t miss out on the massive mobile audience and protect your company from potential litigation. If you are deciding on a mobile SMS provider or are running mobile campaigns, be sure to check with your text message provider to see if they have acquired the appropriate license. If not, you don’t have to turn off your mobile marketing program. Just give us a call, and we’ll walk you through a free demo. We can quickly set you up and import your current subscriber list.

Why every small business needs a mobile friendly website

We don’t leave anywhere without it, it’s always with us & were fanatics about the newest app or the newest iPhone that comes out! That being said, it’s still hard to believe that over 8 out of 10 local business websites are still not mobile optimized. Out of those businesses that engage their customers with a mobile website 84% saw an increase in new business activity due to their mobile marketing efforts! Another important fact for every business owner to consider is a recent study estimates that mobile search will generate 27.8 billion more queries than desktop search by 2016 (Source: BIA/Kelsey, 2012), making it increasingly important for all local businesses to adopt a mobile web strategy.

Why every small business needs a mobile friendly website- With new smartphones and tablets arriving at alarming rates, consumer spending on mobile is set to explode this year. Not only will consumers be buying in hordes the latest smartphone devices but according to Javelin Study and Research, consumers have now spent $20.7 billion shopping directly from their mobile devices.

With people all over the world grabbing up the latest smartphones & or tablets it’s more important than ever to ensure that every business owners websites are mobile optimized. People on a daily basis are using their smartphones for product information, in store price comparisons, mobile coupons and scanning in-store and in-advertisement QR codes. However based on a study by SMB DigitalScape, small and medium sized business owners are still lagging far behind their big box store counterparts when it comes to having their mobile websites optimized and having an effective mobile marketing strategy.

To small business owners the app & mobile world can seem very confusing & to be honest that is not the business they want to be in nor are specialized in. In fact, small business owners have limited marketing resources; 65% act as a one-person marketing department. Business owners don’t know what mobile technology they need, they just want to generate more business. Mobile websites provide the greatest and most immediate return on investment with measurable advantages over traditional advertising. Having a mobile optimized website is no longer an option, as millions of consumers use their mobile phones each day to search Google+ Local for neighborhood products and services. An app won’t help you there.

Earlier this year, Google commissioned a study and found that three-quarters of visitors are willing to return to a mobile friendly website while 79% of people would leave and go to another similar site if the website is difficult to use and navigate on a mobile device.

The importance of a premium mobile website has never been more important. Having a mobile website at the core of any mobile marketing strategy will ensure local businesses will not quickly lose business by not properly engaging their mobile audience.

Canada Mobile Marketing: AvidMobile Launches Canada Mobile Marketing Short-Code

AvidMobile Canadian Short-code launches for SMS White-Label Resellers

(EMAILWIRE.COM, September 24, 2011 ) Blue Springs , MO — Sending SMS messages (or text messages) in Canada just got easier and less expensive. AvidMibile has announced that it finished the provisioning of a more efficient Canadian short-code that it has been launched on the networks for SMS White label’s and their partners to begin marketing and campaigning strategies to Canadian businesses. It has been announced that the actual French conversion to the platform is still in the planning stages, however, they are optimistic about its potential.

SMS In Canada VS. The United States

SMS messaging in Canada varies from that of the United States in the fact that in Canada only 136 characters can be included in a text message’s short-code versus the 160 characters per text message in the United States. Canadian pricing for mobile services is also more expensive than their US counterparts, mainly because Canadian carriers charge more for MO (mobile orginated) and MT (mobile terminated) messages. This being said, the white label of AvidMobile, Canada Mobile Marketing services still costs far less than their competitors.

CEO Speaks Of New Launch

Rob Clifton, CEO of AvidMobile said about the new launch, “Since mobile subscribers that engage in SMS campaigns skew really high to owning a smartphone, the AvidMobile mobile website and app builder is a “must have” feature for any SMS reseller in the market.” He also added, “Although SMS has minor differences in Canada than in the states, the appetite for mobile marketing and SMS programs is verocious!”

AvidMobile: The Future Of SMS In Canada

Keeping an eye on the future, AvidMobile will continue to launch new and improved technology applications in the mobile market using the windfall approach. The level of excitement within the company is great as AvidMobile’s partners to the north will gain a lot of text-messaging revenue.

SMS Reseller Canada FAQs

whymobile SMS Reseller Canada FAQs AvidMobile

Q: What is An SMS Reseller Canada Program?

A: You can think of a Short Messaging System reseller program as your company’s own text messaging service! It’s a web application that can connect to people’s mobile phones not just throughout Canada, but globally as well. This presents a wonderful opportunity for businesses to connect with consumers who are busy and on-the-go. They can send messages about spur-the-moment sales, promotions, surveys, or new product announcements in real-time with excellent open rates. Now you might say, “But we haven’t invested any time, resources, or manpower in the development of a text message platform for our clients.” Yet, we say to you, “Why bother going it alone, when you can take advantage of a fully functional system that’s already been developed?” This SMS platform is already hosted, already created, and already ready-to-go. You need only pay a small licensing fee to use it and slap your own brand on it before offering this great service to your clients.

Q: Why Would You Offer This SMS Reseller Canada Program?

A: We realize that the market is quickly opening up and there are literally hundreds of thousands of customers worldwide who will need this service. We can’t possibly serve them all! What we can do, though, is offer our technology, infrastructure and carrier agreements to other companies who would like to expand their reach to include emerging mobile technologies. That, we feel, is a benefit to everyone. This unique service gives all partners the tools to succeed and exposes our easy-to-use platform to a wider client base than we could have ever hoped to reach on our own.

Q: How Do SMS Reseller Canada Programs Work?

A: The high-speed SMS solution is hosted through our data center, where we manage security, network access and trained personnel. If you or one of your clients have any questions or technical issues at any time, we are here for you 24/7. You can work with clients to develop text message campaigns or let them devise their own using our white label technology that is, actually, for all intents and purposes, your technology now. You can think of us as a silent partner in your business that only jumps in when necessary to make sure your operations are running as smoothly and efficiently as possible.

Q: How Does an SMS Reseller Make Money?

A: While most of our clients are established marketing companies that want to branch out into mobile marketing, we also have some clever entrepreneurs who make their living solely by marketing our mobile technology as their own. They create their own websites and offer to create mobile subscriber lists and marketing campaigns for other businesses. You only pay us a very nominal fee for the use of our SMS platform. You are then entitled to charge whatever fees you wish to your clients for your new mobile marketing services. Most resellers offer various packages, depending on the number of subscribers the clients have in their databases. Other resellers may charge a monthly fee or design fee as well. If you need help creating a fee structure or service agreement, we’d be happy to help you construct one or offer our experience and advice.
